These Terms of Service govern your use of the Fitness Depot website and any purchase made from 1311774 Ontario Ltd. O/A Fitness Depot.

Throughout these Terms, the words “Fitness Depot,” “we,” “us,” and “our” refer to 1311774 Ontario Ltd. O/A Fitness Depot. The words “you” and “your” refer to any person who visits our website, submits information, or purchases products from us.

By accessing our website or placing an order, you agree to these Terms of Service, our Refund Policy, Shipping and Delivery Policy, Privacy Policy, and any product-specific terms disclosed before purchase.

Product-specific descriptions, warranty information, delivery conditions, and final-sale notices form part of these Terms.

4. Prices and Taxes

Unless otherwise indicated, prices are displayed in Canadian dollars.

Prices may change without notice. Applicable taxes, shipping, delivery, assembly, installation, and other charges may be added to the purchase price.

A displayed price or quotation may be corrected if it results from an error, omission, technical problem, or incorrect information supplied by a manufacturer or other third party.

We will contact you before proceeding if a material price correction is required.

5. Orders and Acceptance

Submitting an order does not guarantee acceptance.

We may accept, reject, limit, or cancel an order for reasons including:

  • Product unavailability;

  • Incorrect pricing or product information;

  • Payment authorization failure;

  • Suspected fraud or unauthorized activity;

  • Shipping or delivery restrictions;

  • Errors affecting the order;

  • Inability to complete required delivery arrangements; or

  • Other reasonable operational or legal concerns.

An order is accepted when we confirm acceptance or begin processing, production, fulfillment, or delivery.

We may contact you to verify order, payment, identity, delivery, or access information.

6. Payment

You agree to provide valid and authorized payment information.

Payment may be required in full before an order is processed, unless we agree to different terms in writing.

Deposits, made-to-order purchases, custom orders, and special orders are governed by the terms disclosed at the time of purchase and by our Refund Policy.

We do not promise or provide financing unless a specific written arrangement is separately offered and approved.

7. Shipping and Delivery

Shipping and delivery options, charges, timing, assembly, installation, and availability vary by product, destination, order size, and access conditions.

Customers must call 905-849-8884 to confirm shipping or delivery arrangements.

Shipping and delivery are not confirmed until reviewed and accepted by Fitness Depot.

Additional charges may apply for:

  • Oversized or heavy equipment;

  • Remote destinations;

  • Stairs or elevators;

  • Narrow entrances or restricted access;

  • Inside delivery;

  • Missed appointments;

  • Assembly; or

  • Installation.

Delivery dates and lead times are estimates and are not guaranteed.

Customers must provide accurate contact information, delivery addresses, access details, and information about any conditions that could affect delivery.

Our Shipping and Delivery Policy forms part of these Terms.

8. Risk of Loss and Inspection

Responsibility for a product may pass to the customer when the product is delivered, picked up, or transferred to a carrier, as applicable and subject to applicable law.

Customers should inspect products and packaging promptly after receipt.

Visible damage, shortages, or incorrect products should be reported promptly to:

Photographs of the product, packaging, shipping label, and damage may be required.

Do not discard packaging or assemble or use a visibly damaged product until instructions are provided.

9. Returns, Refunds, and Cancellations

All purchases are subject to the Fitness Depot Refund Policy.

Unless required by law or expressly agreed to in writing:

  • All sales are final;

  • Shipping and delivery charges are non-refundable;

  • Assembly and installation charges are non-refundable;

  • Deposits and payments for made-to-order, custom, modified, or special-order products are non-refundable after processing or production begins; and

  • Order changes or cancellations are not guaranteed.

To request an order change or cancellation, call 905-849-8884 as soon as possible.

Nothing in these Terms limits a right or remedy that cannot legally be excluded.

10. Made-to-Order and Custom Products

Made-to-order, custom, modified, and special-order products are prepared or obtained specifically for the customer.

Once processing, ordering, customization, or production begins, these purchases cannot ordinarily be changed, cancelled, returned, or refunded.

Customers are responsible for reviewing and approving product details, dimensions, colours, specifications, quantities, and other order information before processing begins.

11. Service, Assembly, and Installation

Service, assembly, installation, and maintenance availability vary by product and location.

No general service, assembly, or installation commitment is made unless it is stated on the product page, quotation, order confirmation, or other written agreement.

Customers are responsible for ensuring that the installation site is suitable, safe, accessible, and prepared before delivery or installation.

Additional charges may apply where site conditions differ from the information provided.

12. Product Warranties

Warranty coverage varies by product and manufacturer.

Product-specific manufacturer warranty terms control the duration, coverage, exclusions, claim process, parts, labour, travel, and shipping responsibilities associated with a warranty claim.

Fitness Depot may assist customers with eligible manufacturer warranty claims but does not extend or replace a manufacturer’s warranty unless expressly stated in writing.

Warranty coverage may not apply to:

  • Normal wear;

  • Cosmetic damage;

  • Misuse or abuse;

  • Improper assembly or installation;

  • Unauthorized repair or modification;

  • Commercial use of a residential product;

  • Failure to follow maintenance instructions; or

  • Damage occurring after delivery.

Nothing in this section limits mandatory legal rights.

13. Website Content and Intellectual Property

The website and its content—including text, photographs, graphics, logos, product descriptions, videos, layout, software, and design elements—are owned by or licensed to Fitness Depot and are protected by applicable intellectual-property laws.

You may view and use the website for personal, non-commercial shopping purposes.

You may not reproduce, distribute, modify, publish, sell, scrape, exploit, or create derivative works from website content without prior written authorization.

Manufacturer names, trademarks, photographs, and product information remain the property of their respective owners.

  • Website interruptions will be corrected immediately.

We do not make warranties beyond those expressly stated in writing or required by law.

To the extent permitted by law, Fitness Depot will not be liable for indirect, incidental, special, punitive, or consequential damages arising from use of the website, delayed availability, or use of a product.

Where liability cannot legally be excluded, our liability will be limited only to the extent permitted by applicable law.

Nothing in these Terms excludes liability or customer rights that cannot legally be excluded or limited.

18. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless 1311774 Ontario Ltd. O/A Fitness Depot, its directors, officers, employees, agents, and service providers from claims, losses, liabilities, and reasonable expenses arising from:

  • Your unlawful use of the website;

  • Your violation of these Terms;

  • Your infringement of another person’s rights; or

  • False or unauthorized information submitted by you.

19. Privacy

Our collection, use, storage, and disclosure of personal information are governed by our Privacy Policy.

Shopify and other service providers may process information required to operate the website, accept payments, prevent fraud, and fulfill orders.

20. Termination

We may suspend or terminate access to the website when a user violates these Terms or engages in conduct that may harm the website, Fitness Depot, another user, or a third party.

Obligations and liabilities incurred before termination will continue where applicable.

The remaining provisions will continue in effect.

These Terms, together with the Refund Policy, Shipping and Delivery Policy, Privacy Policy, product-specific terms, order confirmations, and written agreements provided at purchase, form the agreement between you and Fitness Depot regarding your use of the website and applicable purchases.

If product-specific written terms conflict with these general Terms, the more specific written terms will apply, subject to applicable law.

24. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario.

Any dispute will be addressed in the courts of Ontario unless applicable law requires otherwise.

25. Changes to These Terms

We may update these Terms from time to time.

The updated version will be posted on the website with a revised effective date. Changes apply prospectively unless otherwise required by law.

Continued use of the website after an update constitutes acceptance of the revised Terms.
